General Terms and Conditions of Sale

The following general sales conditions apply to all the sales contracts finalized by the website www.italeri.com (hereinafter referred to as the "website") between the purchaser who buys online (hereinafter referred as the “Customer”) and Italeri S.p.A., incorporated under the laws of Italy, with registered office in Via Pradazzo 6/b, 40012, Calderara di Reno, Bologna, Italy, VAT code no. IT00652841206, share capital € 5.200.000, Communication to the Municipality of Bologna Department of Production Activities no. BO n. 03708190370 (hereinafter referred as “Italeri”)

Every contract is subject to the general sales conditions version published on the website at the time when the contract is finalized.

Italeri reserves the right to modify or withdraw, temporarily or permanently, the website (or any part thereof) with or without notice.

We also reserve the right to change the general conditions from time to time.

Definitions

"Conditions" means these terms and conditions; "Goods" means a product (except Replacement Parts) displayed for sale on the Website; “We/us" means Italeri Spa; "You" means the Customer.

Damage to your computer

We make every effort to ensure that this Website is free from viruses or defects. However, we cannot guarantee that your use of this Website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the Website and screen out anything that may damage it. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this Website.

Description of Goods

We will take all reasonable care to ensure that all details, descriptions and prices of Goods appearing on the Website are correct at all times and we aim to keep the Website as up to date as possible.

Packaging may vary from that shown. The weights and dimensions given are approximate only.

Please note, in rare instances, a Good may become unavailable despite the successful check-out. If this happens, you will be notified that the item is no longer available.

Prices

All prices are in Euros and VAT included. We reserve the right at any time to revise prices.

The purchase through our online store does not provide the issue of invoice. If you are interested, before buying contact us by e-mail (shop@italeri.com) and we will give you the related instructions.
If you buy from Countries that are outside UE, you may be charged of taxes and duties. Italeri won’t be responsible of these charges.

Orders and Delivery

All delivery charges must be paid by you. Delivery shall be made at the address specified by you at the time of ordering. We will make every effort to deliver the Goods to you within indicative 8 working days from the confirmation of the order.

We deliver spare parts through Standard Mail Service (Europe delivery in about 15/20 days, outside EU about 30 days).

All times or dates given for delivery of the Goods are only estimates given in good faith and are not conditions or warranties of contract.

Payment

Payment may be made by any of the methods indicated on the Website. Goods will not be shipped unless payment is received in full. Your credit card details are processed only by Unicredit Bank Interface or PAYPAL Website. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.

Damaged or Defective Goods

If you receive damaged or defective good, you must inform us by e-mail to shop@italeri.com as soon as possible and in any case not later than two months after discovery. Failure to do so means that you have accepted the goods.

The Goods must be unmodified, have been properly used under normal conditions and have been properly stored, installed and maintained.

The Goods or parts thereof should be returned to us in their original packing material together with supporting documentation giving the receipt number and the nature of the defect or shortage.

If for any reason a replacement is not available for a damaged or defective item then we will refund the value of the returned goods by the original payment method.

Right to cancel - Returns

Under the Distance Selling Regulations (Italian Law: art. 52 D.Lgs 21/2014) you have the legal right to cancel your order within 14 days from the receipt of the goods. Within this deadline you must send an email to shop@italeri.com. The goods, together with the original receipt, must be returned to us in perfect condition and in the original packing and transport costs are at your charge.

After receipt of the goods in perfect conditions, we will re-credit to your account the sum deducting the transport charges as soon as possible.

We reserve the right to withdraw any Goods from this Website at any time and/or remove or edit any materials or content on this website.

Law and Jurisdiction

This Website, any content contained herein and any contract brought into being as a result of usage of this Website are governed by and construed in accordance with the Italian Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the Courts of Bologna - Italy.
